GENERAL TERMS OF USE

ARTICLE 1 – Definitions

The terms defined in this article and used in these general terms shall have the following meaning:

• "Site": refers to the Site made available to Users by Djok Prestige SAS, accessible on computer, smartphone and digital tablet from the website www.djokprestige.com
• "GTC": refers to these General Terms of Use.
• "Contract": refers to the present contract, concluded between Djok Prestige SAS and the User.
• "Services": refer to the services available on the Site
• "User": means any natural person who accesses the Site by any means.

ARTICLE 2 – Legal notices

ARTICLE 3 – Scope

These GTC define the terms and conditions under which the User accesses the Site and the Services.

Any use of the Site by the User implies full and unreserved acceptance of these GTC. The User agrees to these GTC, acknowledges having full knowledge of them and therefore waives the right to rely on any contradictory document.

The relationship between the Parties will always be governed by the latest conditions in force on the day the User uses the Site. In case of modification of these GTC, the User will be invited to accept the new conditions, which will be applicable to him/her on the day of acceptance.

ARTICLE 4 – Description of the Site and Services

The purpose of the Site is to provide the User with an overview of the services offered and in particular the training provided by Djok Prestige SAS, a business support firm and professional training organization, to enable the User to make contact to register for training, connect to their space and access the intranet.

The User acknowledges that the Site may evolve and that, as such, the Services could be adapted accordingly.

ARTICLE 5 – Access

The Site is accessible online via the website www.djokprestige.com. The Site is not downloadable but only accessible online, access to the Site and this, at each use, requires that the User has an Internet connection and a browser.

To register on the Site for the trainee area, the User fills out a form in which he/she provides Djok Prestige SAS with the information needed to identify him/her, including his/her surname, first name, email. He/she chooses a password. Registration is valid when these GTC have been expressly accepted and the mandatory registration information has been completed.

ARTICLE 6 – User Obligations

6.1 Obligations regarding the use of the Site

As part of the use of the Site, the User undertakes to:

• Declare complete and accurate information when using the site, and update it in case of change
• Not use the site for fraudulent purposes or purposes not provided for in these GTC
• Not impersonate or attempt to connect to an account other than your own
• Not engage in system analysis similar to reverse engineering
• Not download viruses or files potentially dangerous for the integrity of the site

6.2 Obligations regarding content distributed

The User is solely responsible for the content he/she publishes on the Site. He/she guarantees that his/her content respects public order and good morals, does not infringe the rights of third parties, and complies with applicable regulations.

ARTICLE 7 – Account and security

The User is offered reserved and secure access to his/her user account via his/her login and password. The User is responsible for the password and undertakes to be its sole holder. Djok Prestige SAS cannot in any case be held responsible for the consequences of fraudulent use of the password by a third party.

ARTICLE 8 – Intellectual property

All intellectual property rights relating to the Site as well as all the elements that compose it (software, copyrights, trademarks and in particular the trademark "Djok Prestige SAS", logos, ...) are the full and entire property of Djok Prestige SAS, its affiliates, directors and/or its partners.

The User undertakes not to infringe said rights and not to make available to unauthorized third parties the documentation associated with the Site.

ARTICLE 9 – Confidentiality

The Parties undertake to keep secret all information of any nature that they may have collected during the use and/or exploitation of the Site. Djok Prestige SAS undertakes in particular to maintain the confidentiality of the information collected during the User's use of the Site.

ARTICLE 10 – Personal data

For any information relating to personal data collected as part of the User's navigation on the Site, the User can consult the privacy policy available on the Djok Prestige SAS website.

ARTICLE 11 – Guarantees – Liability

Djok Prestige SAS cannot in any case be held responsible for the content published by the User on the Site. Djok Prestige SAS ensures the availability and continuity of the Site as far as possible, but cannot be held responsible for interruptions for maintenance, technical problems or failures of telecommunication systems.

ARTICLE 12 – Duration – Termination

Registration on the Site is effective from the first connection of the User to his/her user account. Said registration is not limited in time. The User may terminate the registration at any time, without notice, by unsubscribing on the Site or by sending an email to Djok Prestige SAS.

ARTICLE 13 – Applicable law and jurisdiction

These GTC, and more generally the relations between Djok Prestige SAS and the User, are governed by French law.

Any dispute arising from the operations covered by these terms shall be submitted to the competent courts.
